ISLC Acceptable Use Policy

For the purpose of this agreement: "ISLC" means Internet Services of the Low Country, an “S” Corporation in South Carolina. "Customer" means a Person who has (1) requested or been furnished with the Service or other communications services from or by ISLC or their respective employees, agents or dealers. (2) Obtained installation or any other form of service or equipment from ISLC or their respective employees, agents, dealers, contractors or suppliers, and includes a User who has signed the preceding page of this form. "Person" includes a partnership, firm, body corporate or politic, government or department or agency thereof and the legal representatives of such person. "Service" means data transmission and communication service furnished by ISLC. "User" means a Person who uses the service or other communications services furnished by ISLC or their respective employees, agents, dealers, contractors or suppliers whether or not that Person is a Customer. "Contract Period" means the recurring period of time, either daily, weekly, or monthly, for which the Customer has purchased services from ISLC. This agreement is by ISLC, duly authorized and existing under the laws of the State of South Carolina, and the Customer for the provision by ISLC of certain electronic communications services in exchange for the payment of fees and compliance with conditions stated herein.

(a) General Conduct. Transmitting, distributing, or storing on or through ISLC systems is prohibited: any services, products or material that is, in ISLC's sole discretion, unlawful, obscene, abusive, libelous, or hateful, or encourages conduct that may constitute a criminal offense, may give rise to civil liability, or may violate any local, state, or federal regulation. This includes, but is not limited to, copyrighted material, threatening or obscene material, or material protected by trade secret, patent or intellectual property. Customer agrees to indemnify and hold harmless ISLC from any claims resulting from Customer's or User's use of this service that damages Customer, User or any third party. No Customer or User is allowed to resell or redistribute the Internet service provided by ISLC including but not limited to the services provided by ISLC. ISLC may permit Customers to provide Internet Service to third parties only under an exclusive written agreement between ISLC and Customer.

(b) Network Security. The following is prohibited and may result in termination of service, recouping costs for repair or service loss, or criminal prosecution: Attempting to circumvent user authentication or security of any host, network, or account ("cracking"); Effecting security breaches or disruption of Internet communications via port scans, ping floods, packet spoofing, forged routing information, deliberate attempts to overload a service and attempts to "crash" a host; Using any script/program/command designed to interfere with a User's terminal session.

(c) Use of E-mail. Prohibited Actions include but are not limited to: Harassment, whether through language, frequency or size of messages, malicious mail such as "mailbombing" (flooding a user or site with very large or numerous pieces of e-mail). Sending unsolicited material to individuals whom did not request such mail ("e-mail spam") and refusing to honor a recipient's request to stop the mail. Creating or forwarding "chain letters" or "pyramid schemes." Unauthorized use or forging of mail header information. Using an ISLC account to collect replies to messages sent from another provider.

(d) Login Restrictions. All accounts, including unlimited Unmetered accounts, are not intended to be full-time dedicated connections and may be disconnected after 60 minutes of inactivity (subject to change without notice). Use of any method to avoid disconnection is not permitted. Session limits of 12 hours (subject to change) are enforced. Multiple logins are not permitted unless approved by ISLC. Shell account users may not run programs that run network services from their accounts. Resources including memory, disk space and session time is controlled at the discretion of ISLC and use of any program that impacts other system Customers or Users is prohibited.

(e) Damages. ISLC reserves the right to collect damages (software, hardware, and labor) or pursue prosecution if any harm is done to ISLC that requires repair and/or configuration.

(f) ISLC May Redirect or Restrict Access. Customers are prohibited from excessive consumption of resources, including CPU time, memory, disk space, and session time. The use of resource-intensive programs which negatively impact other system users or the performance of ISLC systems or networks is prohibited, and ISLC staff may take action to limit or terminate such programs.

(g) IRC/IM Systems. ISLC is not liable for the content of any communications made on IRC (Internet Relay Chat) and IM (Internet Messaging). Customers may not attempt to impersonate others or use IRC/IM anonymously by disguising their hostname or username. Customers are prohibited from using IRC/IM scripts or programs that interfere with or deny service to other users on any server or host. Customers are also prohibited from engaging in activities which harass other users. This includes, but is not limited to, "flooding" (rapidly entering text with the intent to fill the screens of others), "flashing" (disrupting terminal emulation), "takeovers" (forcibly seizing operator privileges), attempting to send private messages to those who do not wish to see them (via "ignore"), attempting to return to a channel after being banned from it, and other disruptive behaviors.

(h) Violation of this Agreement. ISLC does not routinely monitor the activity of accounts for violation of this Agreement. However, in our efforts to promote good citizenship within the Internet community, ISLC will respond appropriately if it becomes aware of inappropriate use of the Services. Although ISLC has no obligation to monitor the Services and/or the network, ISLC reserves the right to monitor bandwidth, usage and content from time to time, to identify violations of this Agreement; and/or to protect the network and ISLC Internet customers.

ISLC prefers to advise customers of inappropriate behavior and any necessary corrective action. However, if you use the Services in a way which ISLC, in its sole discretion, believes violate this Agreement, ISLC may take any responsive actions they deem appropriate. Such actions include, but are not limited to, temporary or permanent removal of content, cancellation of newsgroup posts, filtering of Internet transmissions, and the immediate suspension or termination of all or any portion of the Services. ISLC will not have any liability for any such responsive actions. The above described actions are not ISLC’s exclusive remedies and ISLC may take any other legal or technical action it deems appropriate. ISLC reserves the right to investigate suspected violations of this Agreement, including the gathering of information from you or other users involved and the complaining party, if any, and examination of material on ISLC’s servers and network. During an investigation, ISLC may suspend the account or accounts involved and/or remove material which potentially violates this Agreement.

You hereby authorize ISLC to cooperate with (a) law enforcement authorities in the investigation of suspected criminal violations, and/or (b) system administrators at other Internet service providers or other network or computing facilities in order to enforce this Agreement. Such cooperation may include ISLC providing the username, IP address, or other identifying information about a subscriber, in accordance with the guidelines set out in ISLC’s Privacy Policy. Upon termination of your account, ISLC is authorized to delete any files, programs, data and email messages associated with such account.

The failure of ISLC to enforce this Agreement, for whatever reason, shall not be construed as a waiver of any right to do so at any time.
You agree that, if any portion of this Agreement is held invalid or unenforceable, that portion will be construed consistent with applicable laws as nearly as possible, and the remaining portions will remain in full force and effect.
